Copyright & Takedown Policy
v1.0 · sha256 d48ab45e9675
Version 1.0 · Effective [待填:生效日期]
This policy forms part of our Terms of Service.
1. Our approach
We respect the rights of authors and publishers. Everyone Reader exists so that writers can turn their own work into audio. Every upload requires the user to declare that they own the work or hold a written licence that covers audio adaptation. We record that declaration with a time, IP address and a fingerprint of the text.
Audio we produce is delivered only to the account that uploaded the text; we do not publish it on the Service. Each finished file carries a production reference in its metadata (a code beginning ER-). If you find an audio work you believe was made from your text without permission, quote that reference in your notice so we can locate the source quickly.
2. Reporting infringement (takedown notice)
Send a notice through our online form or by email to copyright@everyonereader.com. To be valid, it must include:
- your name, postal address, email address and telephone number;
- identification of the copyright work you say has been infringed (title, author, and where it is published);
- identification of the material on or produced by our Service that you say infringes, with enough detail for us to find it, such as the production reference (ER-…), the book or chapter title, or where the audio has been published;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf; and
- your physical or electronic signature (typing your full name is acceptable).
Our designated agent for notices under the US Digital Millennium Copyright Act is: [待填:DMCA 指定代理人].
3. What happens next
- We acknowledge your notice, normally within 2 business days.
- If the notice is complete, we promptly remove or disable access to the identified text and Outputs, stop any production in progress and suspend downloads.
- We notify the user, give them a copy of the notice (we may redact your contact details except where the law requires us to disclose them) and record a strike against their account.
- We keep the material and records in restricted storage as evidence, and may share them with you or a court where the law requires or allows.
We may also act on our own initiative when we reasonably suspect infringement, for example when a user cannot produce a licence on request.
4. Counter-notice
If you are the user and believe the material was removed by mistake or misidentification, you may send a counter-notice to copyright@everyonereader.com or through the online form including:
- your name, address, email and telephone number;
- identification of the material removed;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification, with your evidence of ownership or licence;
- your consent to the jurisdiction of the courts of the place where you live (or, if you are outside the United States, any judicial district in which we may be found) and that you will accept service of process from the person who sent the notice; and
- your signature.
We forward valid counter-notices to the complainant. Unless the complainant tells us within 10–14 business days that they have started legal proceedings, we may restore the material. We are not obliged to restore material if we are not satisfied that you hold the necessary rights.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. As a rule:
- 3 valid notices within 12 months leads to permanent termination;
- a single serious or wilful infringement, such as uploading a commercially published book or a work taken from another platform, may lead to immediate termination; and
- terminated users may not open a new account.
Strikes are removed after 12 months, or immediately if a counter-notice succeeds.
6. Misuse of this process
Do not send a notice unless you are the owner, or authorised to act for the owner, and genuinely believe the use is infringing. Knowingly false notices or counter-notices may expose the sender to liability for damages, including under 17 U.S.C. § 512(f). We may ignore notices we reasonably believe are abusive.
